Legal Question in Discrimination Law in Louisiana
is this gender discrimination?
I have been working at the same non-union company for the past 3 1/2 years. For the last 1 1/2 years I have been working in a section where I'm the only female. Due to personnel changes it was necessary to hire 2 new people. Both of these individuals were male and both had less (or no)experience in our particular field, then I do. Both were hired at higher pay grades then I and both were hired at higher salaries then I. For example I am a 94 with 3 1/2 years, another man has 6 months and hired in as a grade 96, the other has 3 1/2 years and is a grade 97 (and has been for 2.2 years) The grading system goes from 93-98. Also both individuals have been sent to schools that I have been waiting the last 1 1/2 years ago. There reasoning is that they are less experienced and new and hope that the schools will help them learn the tools we work on, however I am expected to train these individuals and have receeived no schooling at all.

You definitely have the start of a claim. Start collecting documentation NOW, don't tell anyone you're thinking of suing the company, and get all your employment related manuals, job descriptions, names of all people who might help you, those who will not go against the company, all of that together. Definitely file a written complaint with your local EEOC, but have it looked at by an attorney first. An EEOC complaint is usually a prerequisite to filing a lawsuit, so make sure you get that taken care of ASAP. They'll do an 'investigation' and issue (most likely) a "Right to Sue Letter," telling you that they've done SOME work, but they're essentially not going to do anything. Get all of their paperwork immediately (your lawyer will do that). Make sure that you find out whether any women applied for the job, because it's critical to filing your complaint properly, that you have as much detailed information as possible. After the RTSL, you'll only have 90 days to get into court, so every day counts. Good Luck!
