My attourney didn't file the 894 in time so now I have a dwi record with the DMV and my insurance wants to drop me. Can this be fixed by my attourney if he files the 894 now.

Yes. The expungement is not automatic. You have to file a motion with the court to expunge your record. The cost of getting the expungement is not usually included in the price of the original representation for the criminal charge, so you will have to pay that attorney (or another attorney) for the service.
