Legal Question in DUI Law in Louisiana

Live in Texas, stopped and arrested in LA for DWI. Do we need a lawyer and where should they come from, TX or LA? First offense, no traffic violation was happening.

You should consult with a lawyer, at least to see whether you have any valid defenses. Since you are charged in Louisiana, you would need an attorney licensed in Louisiana.

You need a lawyer licensed in Louisiana. Ideally it should be someone experienced in criminal defense and DWI law.

DWI is among the most complex, non-white collar, non-capital crimes to try. Make sure you get someone truly knowledgeable.

Dear LawGuru Friend,

Let me add my two-bits to what the other two lawyers have said. I believe in lawyers, or I would not be one. Yes, you should have legal counsel any time you come up against the state in a criminal prosecution. It would not really matter whether it was a TX or LA lawyer, the issues are simple. A TX lawyer would need to have a LA lawyer introduce him to the court, but that is an easy matter. A TX lawyer, unless he was from near the LA-TX border might have to charge you too much to come to LA and represent you. Louisiana abounds with good lawyers. Just shop for the cheapest fee. Of course, if you were just flat out drunk as a skunk, it might be cheaper to just return to LA and plead guilty and hope for probation, possibley an 894 sentence where you could get the conviction removed from your record if you complete probation successfully. There are several things a lawyer could advice you about the best way for you to handle this first offense DWI.
