There are too many factors to give you a sure answer. Your blood/alcohol content, your behavior, etc. all affect your chances. Speak to an experienced DUI lawyer.

I would need to know more in order to tell you for certain that you will not go to jail. However, a good lawyer should be able to keep you out of jail and keep your permanent driving record protected.

You should be charged under the "baby DWI" statute, which applies to persons between the ages of 18 and 21. There are good and bad points to the law.

My best advice to you is to get a good lawyer--FAST. You absolutely need representation for a DWI. You really should not try to do it yourself.

If you want to speak to me, send me an email and I will talk to you about your case. If it is in the New Orleans area, I can handle it for you. If not, I will help you find a lawyer. Just, whatever you do...Find a lawyer.

Depending on the facts of your case, your blood alcohol level and if an accident was involved you could could get probation, or possibly some jail time. You need to consult an experienced criminal defense attorney. Preferably in the jurisdiction where you were arrested. Good luck.
