Legal Question in DUI Law in Louisiana

I live in lousiana and am cuurently charged with dwi 3rd offense, A district Judge wants to allow me to be put in his DWI court but the District Attorney has blocked me from participating in the program because of my history with DWI's, Can he do that, I thought it was the Judge of the DWI court who has all authority, so now my case goes back to criminal court. I think this is politically motivated since it's election time! what can I do?

The DA is the gatekeeper for all drug or alcohol courts. You should have your attorney meet with the DA to make a case for you to be allowed in DWI court. A 3d offense means you will have to do in patient rehab before home incarceration in most cases with some possible jail time. That is, unless you have already been this route.
