I recieved a dwi in 2008 and it was filed under art 894. in 2010 my probation was revoked. the dmv has susspended my license again because the dwi just showed up on my record. is this legal?

An 894 though requested at the plea stage is not actually received until a petition is filed to receive it. This can't be done till probation is over. The DPS usually suspends you immediately. You can check directly with them as to why the delay.
