Legal Question in DUI Law in Louisiana

who is responsible???

my brother-in-law has had several

dwi's and doesnt have a vehicle or

license. i let him and his girlfriend

borrow my vehicle only so she could

bring him to work. they went out

one night for her birthday and were

drinking. she ran into the back of

someone and got a dwi in my

vehicle. now the people that were hit

are suing my insurance company. i

received a certified letter stating the

amount they are suing for is over

the amount my insurance will pay.

neither of them had any insurance.

am i still responsible since she was

drinking? if i cant afford to pay could

i lose my home?

The driver and you will be responsible for any amount awarded over your insurance coverage.

I do not know the amount of damages that will actually have to be paid but if the actual liability exceeds the policy limit you and the driver of your vehicle are liable for any excess damages. If she has no money they will try to collect from you. Your insurance company has a duty to defend you (including paying for your lawyer) in this case.
