Simple burglary/probation violation
my son was arrested for simple burglary and violated his probation. he is accused of breaking into a car, but nothing was stolen. his probation officer says we need to get the charges broken down to a misdemeanor and he can recommend the revocation house.my question is: can a charge be broken down by arraignment so that he can plea guilty to the lesser charge before the revocation hearing?he is on a probation hold in the parish prison. also he is in good standing with his probation officer and has followed his probation to a tee up until this new incident.

What he is charged with is the exclusive decision of the District Attorney. The DA can charge him with something less at arraignment. A local attorney might be able to negotiate with the DA and help your son get this deal.
