can a 16 year old minor legally sign custody of her baby to the babys daddy without the consent of her own parents or does she have to wait till she is 18?

I disagree. The age necessary to sign legal documents is 18. At sixteen, a decision like this which will affect the lives of both of these children-mother and child-should not be made by a 16 year old without court approval.
