4 years ago my ex husband came to la from nc with an ex parte custody order and took our son. the order was full of lies however to get him back i had to go to nc to fight him and he knew i didn't have the money. he wasn't concerned about our son just didn't want to pay child support anymore. well this is the first time in 3 years that he's letting me get him. Only because him and his new wife whom he has 2 girls with is going through a nasty divorce. she left him and got temporary custody of the girls and a restraining order on the grounds that hes a threat to the children. i pay child support through the state of la so was told i can bring him to court here. once i have my son here can i have him served with custody papers and keep him until the court date. im afraid what hell do
he already threatned to kill me if this summer doesn't "come out smoothly". I just want my son back hes miserable up there and terrified of his dad and i'm tired of this so called "justice system" helping out only those with money and that can lie with a straight face. Help!! His little brother and sister don't even know him!

Yes, you can file custody papers; howeve, there will be an argument that North Carolina should be the proper forum. You need an attorney and you will need to follow their advice. You may consider "aligning" yourself with his estramged wife, so that she may be able to provide information that will be beneficial to your case.
