Legal Question in Family Law in Louisiana

I have a 17 yr.old that lives with my husband and me in morehouse parish. we travel for a living. my 17 yr.old wants to stay with my parents that live in richland parish. the school board said couldn't cause i don't live there. they said i had to sign over my rights to whom-ever he was going to live with. i was needing to know if he was of age if he could pick where he wanted to live? if not what is the fastest way and cheapest way to give my mother custody? he needs to be back in school. he has all ready missed a week.

(The answer I am giving assumes that you and your husband are the child's legal parents-if that is not the case, there would have to be some modifications made).

The 17 year old is still a minor. He cannot decide where he lives legally. The good news is you can give your parents legal custody in a fairly simple document called a Provisional Custody by Mandate. It is good for one year and is geared toward your type of situation. You can either do this yourself or contact my office and I can set you up an appointment to assist you with this.

Please note that your son needs to be back in school right away or you could be in violation of the Louisiana Truancy laws.
