Legal Question in Family Law in Louisiana

Right of a Abandoned Daughter

My Mother and Father divorced before I was 1. My Father never paid child-support and I didn't even know him until I was 30. I found him. Does he owe me any kind of back-support for all the years growing up without? My Mother raised me alone and we lived in virtual poverty.

Re: Right of a Abandoned Daughter

Your father does not owe you any child support. He does owe your mother child support. Child support is meant to reimburse the custodial parent for expenses in raising a child. Unless your mother when to court in the past and had the support owed confirmed and reduced to judgment, the statute of limitations then in effect have passed and she has no recourse if this is a Texas case.

Support is owed to the child. That is why a parent cannot unilaterally waive child support. However, if your mom did not get a judgment against your father for a certain amount per month, you are out of luck. And even if your mom had a judgment, you have lost your right to collect it since more than 10 years has elapsed since a judgment would have been entered and owing. You do have some inheritance rights to his estate.
