Sorry, I should have added more. can the father be court ordered for child support if he's not listed on the birth certificate? No father listed on birth certificate. My nephew requested and paid for DNA right after birth. No court orders. He supports the child financially and has more than reasonable visitation. The mother threatened to move out of state and went to Texas for a week. Which he refused to pay child support for that week. She filed a TRO on him and they go to court next week. She is asking for child support. He is the father and wants to support the child, but wants his legal rights also. Thank you for responding so quickly.

Being as old as I am, I assume your nephew is the alleged father? Since he supports the child, I also assume the DNA showed he was the father. He needs to file for a custody order and for the court to set child support. She has already done the child support request, but unless the court issues an order of who has custody of the child and when visits take place, then your nephew has nothing. Once there is a custody/child support order in place, she cannot move out of state without a court order or his permission.
