Adoption by stepfather of previously adopted child

My ex-husband and I adopted a child 5 years ago and divorced 1 yr after the child was adopted. The child has my ex-husband's surname. The ex only sees the child a couple of times per month. I'm remarried and have 2 biological children with my new husband. My adopted son wants to have his stepfather's name and is very close to his stepfather, who he looks to as his father in every way. What options do we have for a name change or adoption of my adopted son by his step-father?

You can do an intrafamily adoption if your ex will agree to it. If not, you can attempt to terminate his parental rights in the adoption proceedings. Or, you can simply petition for a name change with or without your ex's permission. It is easier if he agrees. Of course his child support obligation ends with the new adoption.
