Legal Question in Family Law in Louisiana

Back child support reconciliation

In 1999, i received an inheritance from my grandfather, with which i bought a truck for $5800.00. My fiance at the time was sent to the dmv to register the truck for me, but she put it in her name. We separated about 2 years later, she took the truck, and i have not had it since then. Now i owe back child support for our daughter because i have not had my own transportation to keep a steady job. She has taken out a loan on the truck, and never paid me anything for it. Is it possible to file for a settlement which would let her keep the truck reconciling $5800.00 worth of back and future child support? I was told i could sue for payment of the amount of the truck. I would rather make a settlement because i know she doesn't have the money to pay me for the truck. Wouldn't having a free vehicle to use in order to keep a job and support our child constitute my child support? Please also note that she does not have full custody, i have our daughter every weekend. I would like to have full custody if i had a vehicle to ensure my stability, but that is another issue.

Re: Back child support reconciliation

If you can get the judgment against her for taking the truck first, then you can negotiate from a position of strength. You can't trust her, she stole your truck. The judgment is leverage that you don't have yet.
