birth certificate name change - paternity
My fiance has a child by a previous marriage that does not have his name on the birth certificate. At the time of conception his ex was still legally married and by law they had to put the husbands name on the birth certificate. To alleviate any questions about the paternity my fiance went down and had a paternity test done which came back with a 99.7%. I know that he can get a three way form for a name change if all three parties involved can sign but his ex is not the easiest person to deal with. Is there any other alternative to get this issue resolved since he has gotten the paternity test?
Also, once he does get a corrected birth certificate, he wants to move the boys to Texas once we are married. What does he have to do legally in order to alleviate any problems with the ex. The boys now live with him as they have for the past 3 years. It is my understanding that they have joint custody. I am not sure if this is in a written court order or a verbal agreement between them. The ex has very little contact with the boys by her own choice.

He needs to contact an attorney with every available document. If needed he can file a suit to establish his paternity. More information is needed to adequately answer all of your questions.
