Legal Question in Family Law in Louisiana

My boyfriend and I are discussing him adopting my two year old son. His biological father chose not to be in his life and I haven't forced him to be. I am the only parent on my sons birth certificate. Do I need to take his biological father to court and ask that he sign his parenting rights over in order for my boyfriend (whom was there for my sons birth and whom my son calls "Daddy") to adopt him?

Yes. He will either have to relinquish his rights or you can petition to terminate his rights based on over two years of no contact and no support.

A judge will be more friendly to this step-parent adoption if your boyfriend can legally be called your husband.
