Legal Question in Family Law in Louisiana
my boy's dad in Hospital. Ex-wife-still married wants rights
I've been living with my boyfriend for about 3 years which we have a 7 month old boy. He went to work for a few months to Lousiana and suffered a cerebral hemmoragge. After I was there for 3 weeks, I needed to come back to PR to finish some issues. Now his family called his ex wife--but still legally married. and she arrived to the hospital and changed all the papers as her being the wife. I can't see him or call him(well he cannot talk nor write he has a hemi paralisis in the left side and can't speak after the cerebral hemmorage)Do I have any rights or do I have to wait if he is able to talk and wait until he tells them he wants to come to Puerto Rico with me after the Dr. Discharge him from the hospital. My huband and her have been separated for 3 and 1/2 years, the divorce was not yet in place because of financial dificulties. That is why he went to Lousiana, to make extra money so he could get a divorce and marry me. Is there anything I can do?

Re: my boy's dad in Hospital. Ex-wife-still married wants rights
The person that you identify as the wife is the person, depending on Lousiana law that I do not dominate, that most probably is called upon to make some calls regarding his treatment. This is similar to what happened in the Terry Schiavo case recently. However, you may move the hospital to allow you to see him through your kid. The kid wants to see his daddy, and you are the kid's mother, so you slip in and see your loved one. Of course, this depends largely on Lousiana law and hospital regulations which I do not know, and cannot be conversant about.
GOOD LUCK!
