You do not have to Petition the Court. That is a myth. In Louisiana a woman NEVER loses her maiden name and never has to use her husband's name. The only reason it is done is to avoid confusion and so banks and lending institutions can keep track of you and the community property laws encourage it. If you changed your name on your social security account, then all they will want is the divorce decree and last time I looked it does not demand the decree specifically "restores your maiden name." If you never changed your SS account, then nothing to worry about. The real reason most women take the man's last name is if they have children who have the man's last name and they want the same name. But to answer your question directly, YES, you can change your name to your maiden name in the divorce.
