cheld custody

i separated from my husband in Sept of 2008, my biological 9yr son stayed with the only man he has knwn as a father. my husband is not the biological father(he knws this also). my son stayed for many reasons, school, friends, and he did not like the house and area i moved to. i want my son back, myhusband will not give him back to me. Does my husband have any legal right to keep him.

If he has a compelling "best interest of the child" argument (eg. if you are unfit as a parent) then the court can consider him.

If he already adopted your son then your husband is the father.
