child abandonment

My husband and I are seperating but we haven't talked to lawyers yet. We have 3 kids and I want to know is it safe for me to leave at night when he comes home from work, sleep @ a family members and come home early in the morning before they get up, so he can leave for work, but that way we'll have limited contact with each other.

If you are not at home with the children every night for whatever reason, your husband arguably becomes the primary caregiver of the children. So, in terms of "safe", if you are asking could this have a detrimental effect on your case to be the domiciliary and primary custodial parent of the children, I would say that is possible. Perhaps if you and your husband are getting along well enough you could both try to work out a mediated arrangement before separating.
