Child adoption age

My daughter is 14 years old and my present husband would like to adopt her. Her biological father has refused consent to adoption or name change. He has limited visitation rights and only with a immediate member of my side of the families present. He does not have much contact with his daughter other than rare holiday time. At what age can my daughter decide to a name change or adoption with out his consent..If she is not allowed can she be forced to live with him if something happens to me . we have 2 other siblings by my second marriage at home at present with her..

Re: Child adoption age

The father's consent is required to allow an adoption until the child is 17 years old. You can file for intrafamily adoption and allege his consent is not needed if he has failed to pay court ordered child support for a period of 4 months prior to the filing of the petition for adoption, or if he has not visited with his child, voluntarily, for 4 months prior to filing the petition.
