child adoption

I have a son by another man and he has never been in my sons life. He didn't sign the birth certificate but there was a paternity test done. Can my husband just sign the birth certificate or do we need to do a formal adoption.

Just signing the birth certificate does not make him the legal father with all that naturally flows from that. You must file an Intrafamily Adoption. In that you would claim the bio-dad's consent is not necessary because he has neither seen nor supported his son for a period in excess of 6 months. Anyway, get an adoption attorney and go through the procedure. You avoid potential problems that way, and your son will then be able to inherit from his "dad" after the adoption is done.
