Re: Child age

They can testify and virtually any age as long as they understand the obligation to tell the truth. The older the child is, the more weight to testimony is generally given. However, the child's wishes are not the deciding factor.

Re: Child age

For sure when the child is 18, but who would care?

I am not aware of any statutory age for this. Why would anyone want to put the child in this position? In San Diego, the older the child is the more likely "input" from the child may be relevant, but even then it is done by way of Family Court Services (aka Concilation Court in other parts of thre State) if they feel it is appropriate. No then do not put the question to the child quite that bluntly, but they talk around it in an appripriate manner. Even there, it is not so much what the child wants, as why the child may want it. Remember the Santa Claus syndrome. When with one parent, we go to the beach, ball games, movies. When with the other parent, it is "clean your room, do your homework, take out the trash, etc." Kids invented manipulation.
