Legal Question in Family Law in Louisiana

child custody

My husband has not been home

since saturday. I have had to cancel

the debit card because of the many

ATM transactions. ( I dont know if his

card has been stolen or hes up to no

good and cant get a hold of him to

ask) I did send an email letting him

know but have not heard back

We have a 14 month old baby and

have been legally married in

Louisiana for 3 years. He has

assaulted me with a gun in 2006

leading me to legally evict him and

also apply for a restraining order and

call the police. He talked me into

dropping the charges and letting him

move back in of course.

About a year ago we drafted a

document clearly stating that should

problems arise in our marraige

resulting in seperation/divorce or

another assault on me that he gives

me sole physical and legal custodial

rights to the baby. And all decisions

regarding the baby are left to me

including his visitation.

Will this document be enough to

keep him from snatching the baby?

Or should I file another restaining

order and not be talked out of it!

Do I need to evict him all over again?

It will help you in court, but you must file for divorce, and immediate custody of your child. You have wasted too much time already. Do it today or you will regret it and he could take your child.
