Child Custody

My oldest son is moving in with me at the end of May. His mother and I were never married and also have another child together. We went to court years ago to set the support order but we never set up a custody agreement. My question is: Now that he is moving in with me, I want to have the custody and support modified. If we both agree on it, can we draw up the paperwork ourselves and then have an attorney look over it and file it for us? Thanks for the help.
