Legal Question in Family Law in Louisiana

How old does a child have to be to divorce her parents. My granddaughter is gonna be 10 in april and she wants to come live w/me she does not want to live w/her mother.i wanted to fight for her and her sister,but was told I have no rights as a grandparent.Please advise

A child cannot divorce her parents. In order for the court to place her with anyone other than a parent, there must be an agreement to non-parental custody or both parents must be found unfit.

The only place a child can divorce their parents is on TV. You do not say whether you are the Paternal or Maternal grandmother and you do say she wants to divorce her PARENTS, but you also say she does not want to live with her MOTHER. My question is where is dad? I am going to assume you are the dad's mother, so you have been told your rights go through your son and if he is alive and not in jail, then there is not much you can do without have evidence of abuse by the mother. I doubt is there would be any 10 year old children living at home if they got the option of living with parents or with their grandmother!
