Legal Question in Family Law in Louisiana
If a child is placed in Louisiana's "guardianship subsidy" program from foster care, can the legal guardians apply for child support from one or both parents, in addition to the subsidy provided by the State?

If you are a foster parent, the state has custody and the state would have to file for support.
Actually, Guardianship transfers custody to the guardian(s) and they could file for support. However, there is a chance the support would be applied toward the subsidy. So ask the worker and possibly the court. This guardianship concept is brand new in Louisiana and has to do with granting subsidies in certain situations, and grants a bit more rights than mere custody. Since the concept doles out federals funds, there is a chance there would not be an offset. You may be the first to try it and set a precedent.
