Legal Question in Family Law in Louisiana

Child Support and who gets to claim dependent

My question is how is child support calculated between both parents and which parent has the right to claim the child as his/her dependent? Two years ago I went to court to determine the amount of chld support my child was obligated to. At that time my income was a lot less than the father because of maternity leave and child's doctor's appointments. The father at that time also carried her on his health insurance plan and he was told he would get to claim her as his dependent as long all arrears were paid before the end of that year, which was 2003. His obligation was not met therefore I was able to claim her, but at the same time he was told he would get the claim I was told I could still take the child tax credit because the child lives with me. At the end 2004 he still owed arrears so therefore I'm going to get to claim her as my dependent again. How can I get a recalculation of our incomes because I am a provider for her care also. I provide her with medical insurance also and my income is equal to or may even be greater than his. Please calculate my support if I gross $4600-$4800.00 a month before taxes and medical insurance which is about $1300.00 tax a month.

You can get the child support guidelines on the internet, just Google Louisiana Child Support Guidelines. One would need to know his income also. To get a redetermination, you need to file a Rule to show cause in the court which has jurisdiction over your case. Yours, Steve

I agree with Mr. LeBlanc but would add one thing. You need your ex's GROSS monthly income to add to yours to find what is owed.
