Child Support and Grandparents

I am writing for a co-worker who does not have internet access. She has a daughter with whom she and her child's father have each had custody of her. They were not married, but the father's name is on the birth certificate. There was never any court ordered child support issued. The father recently died in an accident. The mother would like to know if there is any possiblity that the grandparents can be held financially responsible (child support) through the court system. Dear Law Guru Friend,

I do not believe grand parents can be held responsible for support for grandchildren. I know that parents can, but not grand parents. Now there may be a more knowledgeable lawyer than I who will come on and prove me wrong, but until he or she does, let this answer stand as the answer to your question. Best of luck!

Your friend and the father of the child are responsible for the raising of their child. Unless the father of the child was a minor could there be any claim that his parents are responsible. If your friend cannot properly provide for her child, why not think adoption. That most unselfish act would assure the baby a chance at a successful life. Since the father was killed in an accident, his child would be first in line to collect damages if someone else was at fault in causing his death.
