Legal Question in Family Law in Louisiana

Child Support in Louisiana

My step son has been garnishment for child support. He is on short term disability with no income. He may need to go on permanent disabilty. He is under a physician's care.

Will the state take his medical condition into account or just place him in jail.

He is still employed by his employer where the garnishment is in effect. He has no income and is living at the expense of relatives. He is 43 years old.

Re: Child Support in Louisiana

He should file a petition to have his support obligation amended. In Louisiana the amount of support is based on income, therefore the recalculation should lower his obligation significantly.
