Our stepson's father is behind on child support. He finally became disabled and our son now receives $159/ month from SSI. The actual child support amount is $450/month. Last time, we went to court, the judge ordered that the father pay the difference in child support not paid by SSI. The father is refusing to pay, stating that we have to accept what SSI pays. We were told by the judge that he must pay the difference when we went for non payment last time. Is there a law stating that we must settle for the amount provided by SSI or does the court order stand. The father does not pay any school supplies or insurance. The only thing he pays is half of the medical bills when our step son goes to the doctor. In the original child custody papers, his insurance premium was included in child support, due to he was never able to keep a job long enough to have insurance. Can you provide some outside feedback, so we know if we should go back to court for child support backpay. Thanks for your time.

The court order stands. However, how can you collect if he is making so little? If this is truly SSI, supplemental security income, then that cannot be used to compute child support. It appears he can get the support reduced. Maybe you husband should adopt your son. That is always a possibility.
