Child Support/Tax Deductions

In my divorce papers it states that my ex can claim our Minor children on taxes (they live full time with me). Our son turned 18, November 26, 2007, my ex paid support until our son's high school graduation (June 2008). Son is now in college, but ex pays nothing. Can I begin claiming son on 2008 taxes, since he is no longer a minor, he is dependent, supported by me, his father send no means of support and divorce papers clearly state MINOR children when referring to his having the right to claim him on federal taxes. He believes that since he paid some support in 2008 he still has the right, I believe since he was no longer a minor that I have the legal right, who's correct?
