Legal Question in Family Law in Louisiana
child visitation
Father filed for visitation rights for his mother. Father will not be visiting child. Father has only called 4 times in the last 2 years to see his child, he stays out of state and his mother stays local. How to provide proof that he has not put effort in seeing his child? I agree with visitation on every other weekend, but not the other dates, due to being too complex (vacation, holiday). How to enforce that visitation plan be dismissed if father misses 1 pick up date. How to enforce visitation is only for father and not other family members? How to prove that I have not denied father visitation? How to state that I only agree with every other weekend visitation? How to filed for increase in child support if father's contact and address info is unknown- father will not give info? Father's income is much higher than what he oringinally reported in 2004. How to get state to determine child support amount based on annual gross instead of last 2 check stubs (father can control his hours)? How to require address and contact info of father? How to request disagreement with moving request to have to report to court when I move and wait for 30day approval to move? Mother of father knows i'm trying to move in order to get a better job.

Re: child visitation
Joint custody and joint custody plans are preferred by courts in Louisiana. Unless your child is in danger visiting family members, you cannot control who the dad lets her visit with during his visitation. Also, the "not moving" provision is in the law and everyone has to follow that procedure. If he is out of state, then he will have trouble visiting. Also, for child support purposes, he is supposed to bring his tax returns as well as check stubs, so you get what you pay for....the DA's office is free. Get a good lawyer.
