mother lives in texas father lives in another state, what state should father get attorney in to protect his rights

Several factors involved here. If there was a divorce, then in the State where the divoce was obtained. That is true especially if there is a custody order involved. If no divorce action filed but a custody or child support petition filed, then in that state. If nothing has ever been filed, then in the state where the child is located.
