My children's father voluntarily gave up his joint custody of the children. This went on for 15 months. Once I filed paper work to have the agreement changed, he change his mind. Now he is back to the 50 /50 custody agreement. He has been doing this for 2 months now. We go back to court in October, which means that he will have been able to establish 4 months of consistency with the children. Will the judge take into account his past behavior or his current behavior

I cannot answer your specific question because I do not have enough information. Is the 50/50 arrangement court ordered or just an agreement the parties followed before someone filed papers with the court? If it is court ordered, how long has it in been in effect? How does the arrangement affect the children?
Yes, the court will consider all factors in determining an appropriate custody arrangement but to answer the question you did not really ask, there is no real way of knowing whether the judge will change a court ordered visitation/custody plan without a lot more information.
