Can my child's father get full custody even if he's not on her birth certificate or any paper work and he has been in and out of jail the child's whole life and he is currently on probation?

If it is in your child's best interest that the father get custody over you, then yes he can get custody. However, he must prove paternity and his ability to support the child from the child's conception.
