Legal Question in Family Law in Louisiana

My child's father and I are living together for monetary reasons at this time but it is not working out. We are going to go our seperate ways when the lease is up. We have no legal custody arrangement. Now he says he wants custody of our child. She has always been with me even when we did not live together. What are my rights. How do I obtain legal custody. I have no problems with her seeing and staying with him but want to have custody. He is not stable enough and can't even pay his rent and bills now, i don't know how can he think he can take care of her. I do most of the daily care and he is just the fun guy.

You need to file a paternity, custody, child support petition. Then he will be declared the father, custody will probably be awarded jointly with you being domiciliary parent and he getting child support, and also child support will be fixed.
