ChildSupport Guide Lines

My question is, when will my childsupport obligation end ??

a. the day the child turns 18 ??

b. until the child gets out of highschool ??

my daughter will turn 18 on January 6th 2000, she will graduate from highschool May 2000

when will my obligation to pay childsupport end ??

This is only a general reply and you should consult your attorney. First, look to the court order for direction, if any. Second, under La Civil Code Art. 142, an award of child support may be modified if the circumstances of the child or of either parent change and shall be terminated upon proof that it has become unnecessary. A special substantive rule that is often applied is that any voluntary act by a parent that renders it difficult or impossible to perform the primary obligation of support and maintenance of his children can't be accepted as a ground for release. For example, incurring business debts (exception where done in good faith to keep business going), or buying a house, or voluntary unemployment or underemployment. Judicial action is necessary for above. However, support may lawfully cease where a child attains the age of majority or emancipation; two or more children when the youngest attains the age of majority or emancipation. An award continues for any unmarried child who is a full time student in good standing in a secondary school, has not reached 19, and is dependent upon either parent. Good luck!
