If a child is born while the mother is in jail, does she automatically loses her rights, for the person who took the child what rigts do they have in getting custody when the only document they have is a notarized letter from the mother giving 6mos guardianship? which will have to be renewed every 6mos. (the mother has 3yrs)

Any interested party can file for custody of a child. The court would determine the child's best interest. However, if the mother is in jail for 3 years, there is a good chance the person having temp custody from the mom can get custody through the court. Should the state get involved then that is a different story.
