Legal Question in Family Law in Louisiana
I am concerned about my Grand daughter she is in Kindergarten and had been doing extremely well grade wise she still is but conduct wise she is not listening. My son and ex daughter in law divorced 9 months ago ; they have joint custody but my Grand daughter up until 3 weeks ago spent the majority of her time with her Daddy living with us (Grandparents) and was doing awesome in school A-B Honor Roll and Conduct Awards for last 2 6 week periods in the last 3 weeks she has had over 15 sad faces and trouble with not listening in the last 3 weeks she now is back & fourth between her Mom and my son who has moved in with a girl friend and now Mom will not let her stay here with us or with her Dad overnight. However she lets her 13 year old son who is my son's Step son stay overnight with my son and his girlfriend. Due to all the stress can we as Grand Parents petition for temporary custody neither parent is putting the needs of this child first. I have been begging and pleading for them to get her in counseling but it falls on deaf ears. Any advice would be greatly appreciated.

You can file for custody but understand that unless you have more than doing badly in kindergarden as your reason, you will lose. And once it is over, don't be surprised when you do not see your son or your granddaughter any longer. And when that happens, you will not be able to file for any grandparents' visits since your son is still alive.
