Legal Question in Family Law in Louisiana

I have court ordered sole custody of my son. His fathered has court ordered sole custody only but has never taken me to court to get them set up. He has paid child support only twice and my son is 3. He has not seen or tried to contact my son in over a year. He is now taking me to court for joint custody (we've never been together or ever had joint custody). Is there any judge who will grant this to him? We also have statements from him admitting his job is selling drugs and he has 8 drug related felonies

In Louisiana it is presumed that joint custody is in the child's best interest. Sole custody will be granted if you can show that the other parent is not providing a stable, safe and wholesome environment.
