DO I have custody if in my divorce degree my x gets the kids and then i go back

welll it is like this,, my x husband lives in slidell lousianna. Back in 1994 he filed for our divorce there. which i lived in mo. to make a long story short he got custody of our two minor children.Back in April of 1995 which i had moved here to tennessee he called me from a gas station and told me to come pick up our minor childern, so i did,, I had the childern from april 1995 up until this june 1999. The problem is back in 1998 i took him back to court here in tennessee and got custody of the minor childern, which he never showed up for court, and like every summer i let the childern go down to slidell to vist their grandmother and dad,, which my x husband has never called and ask for them,, his mother does it all,, and now this time they refuse to send the childern home,, and they are saying that they have custody of the childern and i really do not know what to do can you help? if so please contact me as soons as possible so that i may explain this a little better ,,

So my question is Do I have Custody or does my X Husband?

From what you have set out, yes, it would appear that you have legal custody of the children now and that you could either simply go down to LA and pick them up, file a contmept of court petition against yor ex for his refusal to return them, or file criminal charges against those responsible for refusing to return the kids. Or do all three.

What you must be sure you do NOT do is to wait until the kids are down there for six months and the state of LA the arguably would have jurisdiction for any custody case.

Right now, call an attorney wo does a lot of domestic work and set up an appointment to talk with him or her in person.
