Custody

What are the grounds for a custody agreement when you were not married when the child was born? Does the mother have to be proven unfit? What if the dad is not working at the time and on workmans comp?

The parties can agree privately to a Joint Custody arrangement or he can file in court to establish custody/visitation/support.

While he is on worker's comp that income can be used to set child support. Once he is working again support can be recalculated.

Also, in a custody dispute, you do not necessarily have to prove any of the parents unfit. The decision is based on the best interest of the child. Even in cases where both parties are excellent parents, the court has to determine what is in the child's best interest.
