Custody

I have a 7 month old son and his father and I recently spilt up, I have no problem with joint custody. He cheated 3 weeks before I had the baby and he kicked us out with no place to go and no job. He makes $20 an hour, if i take him to court how much can I get and will the cheating and all matter?

Very basically, $20 X 40 = $800 x 52 = $41,600/12 = $3,467 a month....

According to the chart found at Revised Statutes 9:315.19, he would owe you about $521 a month plus he would need to keep the child on his health insurance at work of buy a separate policy on the child.

The figures Mr. Pizzolatto gives are approximately correct. There are factors that can increase (eg. exceptional medical costs) or decrease (eg. a pre-existing support obligation to another child) the basic numbers. An attorney can guide you through this process relatively inexpensively.

The cheating does not change the child support obligation.

The amount of child support will depend on facts in addition to what he earns. In general, to answer this question, I would need to know whenther you work and what is your gross monthly income, what is the cost of any health insurance coverage for the child and who pays it, and whether there is any day care cost necessary for work and who pays it. The answer can also be affected by the ultimate custody arrangement. But, if the only factor is that he makes gross income of about $3475 per month, then child support would be about $570 per month assuming a traditional type custody arrangement where he visits every other weekend, half the holidays and half the summer. The cheating does not affect the child support. You may also be entitled to spousal support.
