custody

how likely am i to regain custody of my son who has lived with his father for over two years?

I originally had physical custody but my son wanted to go and live with his father. I signed a piece of paper agreeing that my son could move to Indiana with him, but now they are living back in Louisiana. now i want him to live with me because his father is nothing but a liar! I don't want my son to grow up in his home anymore. is there any hope of getting him back! he is eight now.

Dear LawGuru Friend,

Based on only what you post here in your question, I say the odds are good of your getting Joint Custody, if you seek it, and also good that the Court will name you the domiciliary parent. If you will send me your address or FAX number, I will send you a copy of the local "Family" Court's Suggested Joint Custody Stipulation/Judgment. This will give you a better idea of what Joint Custody is all about. Of course, I suggest you get you a good lawyer to represent you; and, quite frankly, I never knew a lawyer who was not a good lawyer. There is more to it all than this, but this is something to think about. Good luck!

Meet with a lawyer within 50 miles of where your husband lives. Discuss the matter with that lawyer.

Joint custody is very common in Louisiana and would probably be awarded. You will need a better (or at least a more detailed) reason than "his father is a liar" for removing the child from the father's home.
