Legal Question in Family Law in Louisiana
Custody/Support Question
In the 5yr since we split my ex has never once called his son, wrote letters, or even called me to ask how he is doing. There are no bad feelings between us keeping him from doing so. He calls right before his time for summer visitation to arrange to pick my son up, and the same for his holiday visitation. Right now we live 6 hours from him and he is supposed to get 1 weekend a month, he knows we could move further away at any time but in the 4yrs we have been here he has never come for a weekend visit with his son. We were married and divorced in AR. My husband is Military and we currently live in LA and we have lived here for almost 4yrs. My first question is can I hire a lawyer(for change in custody agreement and child support modification) and take my ex to court in LA or do I have to go back to AR? I am wondering if I took him to court would I have any kind of chance at full custody of my son? I know he would still have his visitation and it wouldn't be much different from what we have now, but I don't think that I should have to contact him or discuss and big decisions regarding my son seeing has he has no interest in him.

Re: Custody/Support Question
Since the child has lived in Louisiana more than 6 months, he is considered a Louisiana resident. You can file all of your matters in Louisiana.
As to the issue of full custody, see a lawyer in your area. There are possibly more issues than you've mentioned here and a consultation with a good family law attorney will lead to your answers.
