Legal Question in Family Law in Louisiana

My daughter was born a week after my divorce was final. Because of this no custody agreement was ever done. Next year I'm going to move to the Netherlands, but I need his permission to get a passport. I don't have the money for a lawyer. Can I write up a non-contest form stating that he gives me permission to move and have him sign it? Would that have to be notarized? He is an illegal alien since our divorce and has a warrent for his arrest right now. I need advice.

You will not be able to get your daughter a passport without the father appearing with you or papers giving you sole custody. If the passport office will accept an agreement that you can leave the country with the child, his signature will have to be witnessed and notarized. They may have additional requirements.
