Legal Question in Family Law in Louisiana

My daughter is doing 5-15 and her husband is in another state doing 5 for rape I am the paternal grandmother of their 3 year old daughter what are my chances of gaining legal custody

It depends on who has custody now. Someone has to have custody since the parents are both in jail.
