Daycare Center

We have a parent who wants a copy of our sign in and out sheet because of a custody battle. Due to confidentiality of the other children, do we require a court order or can we just black out the other signatures and give them a copy that way of their own child?

Assuming each person signing the sheet can see the other information, then it really is public information. But you would still be wise to simply black out the other signatures and any other information specific to the other kids.

If the people signing don't have an opportunity to see the information relating to other kids, then you might want to require a subpoena simply because you're already providing a heightened level of privacy protection. But I think a judge would agree with you simply blacking out the non-relevant information.

I am not sure if there is any type of privacy law protecting these records. I would ask for a subpoena and I would black out the other names.

However, if the parent who is asking for the sign in and out sheet, is the only parent of the child in question who signed the child in and out, then there may be no privacy issue. That is because that parent has the right to waive any potential privacy issue. If that is the case, then I would have that parent sign a waiver agreeing to release the records.
